Supreme Roofing and Waterproofing – Terms & Conditions of Contract
1. General Conditions

These terms apply to all quotations, estimates, and work orders issued by Supreme Roofing and Waterproofing.

Any term supplied by the customer that conflicts with these conditions has no force.

Any change to these terms must be recorded in writing and signed by a director of Supreme Roofing and Waterproofing.

Work is accepted once the customer returns a signed copy of the quotation or contract. The person signing accepts full responsibility for payment.
2. Worksite Requirements

The customer must maintain a safe working space, including control of children, pets, elderly persons, and any visitors while work is underway.

By signing the contract, the customer grants access to all power and water needed for the work.
-
The customer must provide uninterrupted access to the site during normal working hours.
3. Pricing, Deposits & Payment
-
The quoted price is fixed and not subject to deductions unless agreed in writing.
-
A 70% deposit is payable upon acceptance of the quotation unless otherwise agreed in writing.
-
The remaining balance is due immediately on completion and on presentation of the final invoice.
-
Guarantees will be issued only once the invoice is paid in full.

If payment is not made within 7 days of the final invoice, Supreme Roofing and Waterproofing may proceed with legal action. The customer will be liable for legal costs on an attorney-and-own-client scale.

All materials remain the property of Supreme Roofing and Waterproofing until full payment is received.

If payment is not made, the company may recover and remove all materials supplied, and the customer grants permission for access to do so.
-
Cancellation of an accepted quotation carries a 10% fee to cover administrative and banking costs.
4. Performance of Work

Work will be carried out according to the signed quotation.

Any verbal instruction by the customer is at the customer’s own risk. All changes must be recorded in writing.

Any additional work requested during the contract will be quoted separately and paid in full before commencement.

Where hidden defects or unforeseen problems arise, a new quotation will be submitted.
-
All work is subject to delays caused by factors outside the company’s control, including severe weather, fire, strike action, or similar events.
-
Supreme Roofing and Waterproofing reserves the right to cancel the agreement after further inspection if work cannot be completed due to an error in the original quotation.
5. Customer Responsibilities
-
The customer must remove or protect all furniture, fittings, fixtures, vehicles, and other items to avoid damage during the project.
-
Roofs and gutters must be kept free of leaves and debris after completion.
-
Under-tile insulation is excluded unless specifically quoted.
-
No oral agreement will modify the contract unless recorded in writing and signed by both parties.
6. Guarantees & Maintenance
-
Standard guarantee period: 10 years (workmanship and products).
-
Maintenance is required every 2 years at the customer’s cost.
-
The customer must contact Supreme Roofing and Waterproofing one month before maintenance becomes due.
-
Failure to carry out the required maintenance will void the guarantee.
-
Any claim under guarantee requires a R1000 deposit before inspection. If the fault is due to poor workmanship, the amount will be refunded.

The guarantee does not apply if:

Work has been performed by any other contractor on the same area;
-
Damage results from hail, third-party activity, or structural failure;
-
Delamination, cracking, or deterioration is caused by external factors;
-
Roofs are not maintained as required.

The guarantee excludes rust, damp, and cracks.
-
Damage from extreme storms or weather reported in the media is excluded.
-
The customer must contact Supreme Roofing and Waterproofing before the guarantee expiry date for a free inspection and quotation for final-year maintenance.

Failure to make payment when requested during the project results in loss of guarantee rights.
7. Claims & Liability
-
Supreme Roofing and Waterproofing is not responsible for any injury or loss suffered by the customer or any third party during the execution of the work.
-
Liability is limited to the original contract amount and does not extend to indirect, special, or follow-on losses.
-
Claims relating to work carried out by another contractor on an area under guarantee will not be accepted.
8. Additional Provisions
-
Supreme Roofing and Waterproofing is not liable for structural defects where waterproofing is applied. If failure occurs due to a structural problem, the guarantee is void.

The company is not liable for brittle or weathered TV cables that may break during work.

Any area not specifically listed in the quotation is excluded.
-
No unwritten changes to dates or timeframes will be accepted.
-
If the customer suspends or cancels the work, payment for work completed up to that point becomes immediately due.
9. Maintenance Plan (Complexes Only)
-
The 10-year guarantee applies with compulsory maintenance every 2 years at the customer’s cost.
-
The customer must contact the company one month before maintenance becomes due.
-
Tiled roof maintenance includes resealing ridging, replacing broken tiles, and repairing hail damage.
-
Flat roof maintenance includes resealing delaminated areas and cleaning stormwater outlets.
10. Contact & Complaints
Customers must report any concern or dissatisfaction within 7 days of completion.

Supreme Roofing and Waterproofing aims to respond promptly to all queries and concerns.
11. Severability
If any clause is found to be invalid or unenforceable under applicable law, the remaining clauses remain in effect.
